MAIER SPORTS ADVENTURE CAMP COMPETITION

Conditions of participation - Website

 

 

1.      The organiser of this competition is Maier Sports GmbH, Nürtinger Str. 27, 732557 Köngen (hereinafter referred to as the Organiser).

2.      Participation in the competition takes place via the website: www.maier-sports.com/erlebniscamp by means of clicking the – Apply now–button, as well as filling in the mandatory fields of the questionnaire and the checkbox. When registering, participants must upload at least one photo, a short text, a video or another file and answer questions about themselves (title, first name, surname, email address, country). Only complete applications will be considered by the organiser.

3.      By entering the contest, the participants accept the conditions of participation.

4.      The procedure: Participant fill in the mandatory information on the entry template and send the form to Maier Sports by clicking on the “Enter now” button. Each participant can only participate once in the competition.

5.      You can win 1x2 places at the Maier Sports Adventure Camp. The winner may choose the person accompanying them.

6.      The Maier Sports Adventure Camp from 10.10.2024 - 13.10.2024 includes various sports activities and three nights with half board at the Lechzeit Hotel in Elmen, Austria. The prize also entails personal outdoor equipment from Maier Sports for each winner and his/her accompanying person.

7.      Entry period of the competition: 10.04.2024 / 00:00 hrs. to 12.05.2024/ 24:00 hrs.

8.      Persons from Germany, Austria, Belgium, the Netherlands, Luxembourg and Switzerland who are at least 18 years old at the time of participation are eligible to participate.  Employees of Maier Sports GmbH and the Schwan-STABILO Group and their relatives are excluded from participation.

9.      All costs associated with the prize, in particular the costs for travelling to and from the event, as well as meals beyond half board, are to be borne by the winners themselves. The winners and their accompanying persons are responsible for the necessary travel arrangements, e.g. travel insurance.

10.  Should the winner not be able to travel for reasons outside Maier Sports’ responsibility, he/she shall lose the right to the prize and is not entitled to any compensation.

11.  Participation is free of charge and independent from the purchase of goods or services.

12.  With participation in the Maier Sports Adventure Camp, the participants agree that their first name, pictures and texts from the application may be published on the official Maier Sports website as well as on the Maier Sports Facebook page and Maier Sports Instagram page.

13.  Maier Sports is not obliged to check the content provided by the participants of third-party rights. However, Maier Sports is entitled to reject content it, in its opinion, it is unlawful or contrary to morality. By uploading content, in particular images, participants declare that the content is free of third-party rights. Meaning that the content either originates from the participant or that he/she has obtained the consent of the authors and the persons depicted in the images and videos. The participants release Maier Sports from all claims of third parties that have arisen due to the use of the content provided. The participant agrees to support Maier Sports in every reasonable way in the defense of these claims.

14.  The selection of the winners will take place by 21.05.2024. The winners will be selected after the closing date based on the information received and shall be informed about the prize by e-mail. The following criteria will be considered when determining the prize winners: The photo of the most beautiful winter outdoor experience.  

15.  The winner must confirm receipt of the prize notification to Maier Sports immediately after reception of the e-mail, at the latest by 29.05.2024, and provide the required additional information (telephone number, clothing size, address, etc.). Failure to do so, will entitle the Organiser to draw new winners.

16.  WITHDRAWAL

Participants are free to withdraw from participation at any time by sending a withdrawal notice to service@maier-sports.de. Participation in the competition is excluded with the deletion of the data.

17.  The Organiser reserves the right to change the program of the Maier Sports Adventure Camp as well as to suspend the event completely or temporarily or to change the date.

18.  Cash payouts of the prize or its transfer to other persons are not possible.

19.  In addition to the winners and Maier Sports employees, a photo and film team as well as 3-4 influencer/blogger will be participating in the Adventure Camp.

20.  Right of use – photos and videos

Maier Sports points out that photos and videos will be taken during the adventure camp. The winners and their accompanying persons agree to the publication of videos and pictures on Maier Sports social media channels, such as Facebook, Instagram and on the Maier Sports website, which are created by Maier Sports for promoting future adventure camps.

21.  Exclusion of liability

Maier Sports shall be liable without limitation insofar as the cause of the damage is based on intent or gross negligence. Furthermore, Maier Sports is liable for the negligent breach of essential obligations (cardinal obligations), the breach of which endangers the achievement of the purpose of the contract, or for the breach of obligations, the fulfilment of which enable the proper implementation of the adventure camp in the first place and on the compliance with which the contractual partners regularly rely. In this case, however, the Organiser is only liable for the foreseeable, contract-typical damage. Maier Sports is not liable for the negligent breach of obligations other than those mentioned in the above sentences. The above limitations of liability do not apply in case of injury to life, body, and health. The liability according to the product liability law remains unaffected. To the extent that liability is excluded or limited, this also applies to the personal liability of employees, representatives, and vicarious agents of Maier Sports. 

22.  Data protection

The person responsible in terms of data protection is Maier Sports GmbH, Nürtinger Str. 27, 73257 Köngen. For further information on data protection, please refer to our policy on data protection when participating in competitions.

23.  Jurisdiction
Legal recourse is excluded. The law of the Federal Republic of Germany applies (if applicable, in combination with indispensable regulations of Swiss, Austrian, Belgian, Luxemburg and Dutch law).
